1. Introduction and acceptance

These Terms of Service ("Terms") govern your access to and use of the website maximuseu.com (the "Website") and any purchases made through it. They form a legally binding agreement between you ("the customer", "you") and Maximus EU ("we", "us", "our"), the operator of this Website.

Browsing our Website and adding items to your cart does not constitute a binding contract. A legally binding purchase contract between you and Maximus EU is formed only when we send you an order confirmation email confirming that your order has been accepted and is being processed.

We reserve the right to decline or cancel any order at any time prior to dispatch, including in cases of:

  • Pricing errors or inaccuracies on the Website
  • Unavailability of the product
  • Suspected fraudulent activity
  • Inability to verify payment

If your order is cancelled after payment has been taken, a full refund will be issued to your original payment method within 5–10 business days.

5. Products and descriptions

We make every reasonable effort to ensure that product descriptions, images, dimensions, and specifications displayed on our Website are accurate and up to date. However, we cannot guarantee that your device's screen will display colours exactly as they appear in reality, or that product descriptions are entirely free from error.

In the event that a product is materially different from its description on our Website, you are entitled to a remedy in accordance with our Return & Refund Policy and EU consumer law.

We reserve the right to modify, discontinue, or withdraw any product from sale at any time without prior notice.

6. Pricing and currency

All prices on our Website are displayed in Euros (€) and include applicable VAT where required by law. Prices are subject to change at any time without notice, but changes will not affect orders that have already been confirmed.

Shipping costs, if applicable, are displayed separately at checkout before you finalise your purchase, in accordance with Article 6 of Directive 2011/83/EU. You will never be charged for costs that were not clearly communicated to you prior to completing your order.

In the event of a clear and obvious pricing error on our Website (e.g. a product listed at €0.01 due to a technical fault), we reserve the right to cancel the order and issue a full refund, even after an order confirmation has been sent.

7. Payment

We accept payment via the methods available at checkout, which may include credit and debit cards (Visa, Mastercard, American Express) and other options provided through Shopify Payments. All transactions are processed securely using SSL encryption.

By submitting your payment details, you confirm that you are authorised to use the payment method provided and that the billing information you supply is accurate. Maximus EU does not store your full card details — payment data is processed and held securely by our payment provider.

We reserve the right to carry out fraud verification checks and, where necessary, to request additional identification before processing an order.

8. Delivery

Delivery terms, estimated timeframes, shipping costs, and related conditions are set out in full in our Shipping Policy, which forms part of these Terms. We encourage you to read it before placing an order.

Risk of loss or damage to the goods passes to you upon physical delivery. If delivery is delayed beyond the agreed timeframe through no fault of your own, you have the right to request delivery or to cancel your order and receive a full refund under Article 18 of Directive 2011/83/EU.

9. Right of withdrawal and returns

Your rights regarding returns, exchanges, and refunds are governed by our Return & Refund Policy, which forms an integral part of these Terms and is fully compliant with Directive 2011/83/EU. You have the right to withdraw from your purchase within 14 calendar days of receiving your order, without giving any reason.

Nothing in these Terms limits or waives any statutory rights you hold as a consumer under applicable EU or national law.

10. Intellectual property

All content on this Website — including but not limited to text, images, graphics, logos, product descriptions, and the overall design — is the intellectual property of Maximus EU or its content licensors and is protected by applicable copyright, trademark, and intellectual property law.
